What is DWI?

DWI means to drive or operate a motor vehicle on a public street or highway while not having the normal use of your mental or physical faculties by reason of the introduction of alcohol, drug, dangerous drug or some combination of alcohol and drugs into the body or having an alcohol concentration of .08 or greater. DWI is unlike most other crimes because whether or not you are intoxicated is opinion.

If I am arrested for a DWI, should I take either a breath or blood test?

No. You are providing evidence for the government that you don't have to give them.  Why would you give the police more evidence to help them attempt to prove their case?

Can any attorney handle a DWI case?

Yes, any licensed attorney could handle your case.  However, there are many issues in DWI cases which only a competent lawyer knowledgeable about DWI law and issues will recognize.  Your attorney should carefully examine the evidence in your case including police reports and any videotapes that exist.  An attorney without sufficient experience handling DWI cases may not be able to uncover any mistakes the police may have made during their investigation, thereby hurting your chances to receive a favorable plea offer or acquittal at trial.
